Terms and Conditions

1. Giveaway includes economy flights and shared accommodation for 2 adults traveling to any one of the following locations, Hawaii, Las Vegas, New York, Los Angeles, Hong Kong, Dubai, France, Italy, Spain, Macedonia, Serbia, Greece, Croatia, Switzerland, Austria, Cabo San Lucas.

2. Total Package valued at $5,000.

3. Location, Date and Time of Travel must be within 12 month of draw.

4. Location, Date and Time of Travel is to be agreed to by winner and principal of Coleman and Co. Real Estate, however if an agreement cannot be reached Coleman and Co. reserve the right to make all necessary decisions.

5. Holiday period will be subject to destination and valued at no more than $5,000.

6. Draw will only take place once we have sold and settled 10 properties.

7. Each property may only have one entrant from the seller and one entrant from the buyer.

8. Only the seller and buyer of the 10 properties will be in the draw.

9. Only 20 entrants, opportunity to win is 1 in 20.

10. Draw will take place upon reaching 10 settlements within a 6 month period by Coleman and Co. Real Estate.

11. If 10 sales/settlements have not been met by the end of the 6 month period, the draw will be cancelled.

12. Prize is not redeemable for cash.

13. All home owners can register to be in the running to enter the draw.

14. Entries must include all requested contact details, including a valid email and postal address, to be eligible to win. Entrants may only enter in their own name. Incomprehensible, illegible, and incomplete entries will be deemed invalid.

15. Entrants will be notified when the draw will take place.

16. Entrants will be notified of the location of the draw.

17. All entrants will be notified that they have been successful in becoming an entrant in the competition.

18. Prize is non transferrable.

19. Tickets and Accommodation must be booked within 30 Days of draw and winner selection.

20. All entrants must attend the draw.

21. Coleman and Co. Real Estate reserve the right to withdraw the competition if terms and conditions of minimum entrants is not met.

22. Winner will be drawn by Coleman and Co. Real Estate Staff Member or Flight Centre Staff member.

23. The draw will be held at the Carnes Hill Marketplace, however if for any reason this changes Coleman and Co. reserve the right to change location only once all entrants have been notified by mail, text message and email.  If you do not receive the mail, text message or email Coleman and Co. will not be held responsible.

24. Winner of the draw must choose a companion to travel with them on the same flight during the same period and sharing accommodation.

25. Location and accommodation availability is subject to flight centres availability and Coleman and Co. will not be held responsible if your chosen destination or accommodation is not available for your chosen period of travel.

26. Hotel is based on double or twin share, single occupancy will be subject to additional cost, which is not covered by this prize.

27. Photo ID will be required to confirm your identity and ownership or prior ownership of sold/settled property.

28. Once flights and accommodation have been purchased there can be no changes to flights or accommodation.

29. In the event a winner does not take the prize by the time stipulated, then the entire prize will be forfeited by the winner and cash will not be awarded in lieu of the prize.

30. Unless expressly stated in these Terms and Conditions all other expenses are the responsibility of the winners (and their companions) including but not limited to current passports, visas, travel insurance, meals, spending money, transport to and from departure and arrival points, transfers, drinks, incidentals, 2 mini-bar, laundry, room service, telephone calls, activities, gratuities, services charges, travel insurance, pre and post accommodation, optional activities or excursions and all other ancillary costs. A credit card imprint or cash deposit may be required from the winner at check-in to the hotel, for all incidental charges. Holidays are subject to flight and booking availabilities.

31. By entering this competition, and by collecting a prize, the winner acknowledges and accepts that driving, travel and any other activities comprising the prize, are inherently dangerous and may result in death, injury, incapacity, damage to property or other losses.

32. The Promoter and Flight Centre are not responsible for any acts of god, adverse weather conditions or industrial action or civil commotion that may occur whilst the winner is travelling. It is the responsibility of the prize-winner to enquire about local issues and conditions at destinations prior to travel.

33. The Promoter does not guarantee that the winner will enjoy the travel prize or be suited to the type of travel prize that is offered.

34. Travel arrangements to and from the winner’s home and the departing airport Sydney do not form part of the prize and are the responsibility of the winner and their travelling companion/s. The winner must travel on the same flights and itinerary as their travelling companions. The travel prize cannot be used as part payment for another airfare package. Frequent flyer points cannot be accrued on this prize. Flights and accommodation are subject to availability at the time of booking and cannot be exchanged for other destinations. Travel restrictions & blackout dates apply.

35. Bookings are subject to conditions & availability (including but not limited to capacity limitations and other restrictions).

36. Compliance with any health or other government requirements is the responsibility of the prize winner and their travel companions. All prize travel will be subject to the carrier’s General Conditions of Carriage. The Promoter and carrier make no representation as to the safety, conditions or other issues that may exist at any destination. International travel advice can be obtained from various sources, including local government, local consular offices and the web site of the Australian Department of Foreign Affairs and Trade at www.smartraveller.gov.au. Prizes for travel for a particular event or attraction must be taken to coincide with the event or the times and dates during which the attraction is available. Travel insurance is not included in the prize.

37. Any entrant found to have used a third party (including online competition entry site) to enter on their behalf will have all entries invalidated and any claim they have to any prize will be invalidated. If such an entrant is awarded a prize and then found to have breached this clause, the entrant must immediately return any prize awarded. The Promoter has sole discretion to determine if this clause has been breached by any entrant.

38. The Promoter reserves the right to request whatever documentation it deems necessary to confirm if the entrant has breached this clause. An entrant must provide any requested documentation to the Promoter upon request.

39. Any entrant found to be entering incorrect contact details, including incorrect email contact details, will have all entries invalidated and any claim to any prize will be invalidated. If such an entrant is awarded a prize and then found to have breached this clause, the entrant must immediately return any prize awarded. The Promoter has sole discretion to determine if this clause has been breached by any entrant. The Promoter reserves the right to request whatever documentation it deems necessary to confirm if the entrant has breached this clause. An entrant must provide any requested documentation to the Promoter upon request.

40. If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to State legislation. Cash will not necessarily be awarded as a substitute.

41. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and prize supplier’s requirements. Each prize must be taken as stated and no compensation will be payable if a winner is unable to use the prize as stated.

42. The Promoter highly recommends a current residential street address be provided when requested for ease of correspondence and potential prize delivery. The Promoter makes all reasonable efforts to deliver prizes to the addresses provided by competition entrants. The Promoter cannot guarantee that any prizes returned to the Promoter due to non-delivery at the provided address will be re-sent to the prize winner.

43. The Promoter reserves the right to request winners to sign a winner’s deed of release or any other relevant forms or agreements that the Promoter deems necessary, to provide proof of identity, proof of age, proof of residency at the nominated prize delivery address and/or proof of entry validity in order to claim a prize. Proof of identification, residency, age and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.

44. The Promoter reserves the right to conduct a redraw in the event that an entrant, claiming to be a winner, is unable to satisfy these Terms and Conditions or has breached these Terms and Conditions.

45. The Promoter’s decision in relation to any aspect of the competition is subject to State legislation but also final and binding on each person who enters. No correspondence will be entered into. No responsibility is accepted for late, lost or misdirected entries. Prizes are subject to availability, not transferable or exchangeable and, with the exception of cash prizes, cannot be taken as cash. Prizes will be sent to the winner’s nominated address as stated in their original entry. The Promoter and their associated agencies, and companies associated with this promotion will take no responsibility for prizes damaged or lost in transit.

46. In participating in the prizes, the winners agree to participate and co-operate as required in all editorial activities relating to the Competition, including but not limited to being interviewed and photographed. The winners (and their companions) agree to granting the Promoter a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide, including online social networking sites, and the winners (and their companions) will not be entitled to any fee for such use.

47. Prize-winners are advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of that prize.

48. The Promoter (subject to State legislation) reserves the right to amend, cancel or suspend this competition if an event beyond the control of the Promoter corrupts or affect the administration security, fairness, integrity or proper conduct of this competition. The Promoter will disqualify any individual who has tampered with the entry process or any other aspect of this competition. In particular, SMS entries via the Internet, computer generation and use “scripting” is not permitted and will not be accepted.

49. Any cost associated with accessing the promotional website is the entrant's responsibility and is dependent on the Internet service provider used.

50. If for whatever reason the winner or their chosen companion is unable to obtain a visa or necessary travel documentation or is prohibited from leaving the country for any reason or is unable to get time off work and their fore the prize will not be used, Coleman and Co. reserve the right to cancel the prize and/or redraw the prize, this will be at the discretion of Coleman and Co. at the time of the disqualified entrant.
